Terms of Service

These Terms may be updated at any time without prior notice — changes can be made to reflect new features, legal requirements, or shifts in how we operate. For significant changes, we will make reasonable efforts to notify you through the Service or via other appropriate channels. Continuing to use the Service following any update constitutes your acceptance of the revised Terms.

We reserve the right to alter, suspend, or discontinue all or any portion of the Service at any time, with or without notice, and without obligation or liability to you, to the extent permitted by law.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for non-commercial purposes only. This is the full extent of the rights we extend to you.

HypeReel and its licensors hold all ownership rights to the Service and its underlying components — this includes software, AI models, algorithms, interfaces, designs, text, graphics, logos, and trademarks. User-Generated Content is excluded from this ownership claim. These materials are protected under applicable intellectual property laws worldwide.

Any use of the Service that goes beyond what is explicitly authorized here may lead to immediate termination of your access and may expose you to legal liability.

Age Requirements

HypeReel is available only to users who meet the minimum age set by the laws of their jurisdiction — typically 18 years of age. Anyone under this threshold is not permitted to access or use the Service.

Users who have reached 18 but remain under the age of majority in their jurisdiction must have a parent or legal guardian review and agree to these Terms on their behalf, and that adult must actively supervise their use of the Service.

Our Stance on Child Safety

We have zero tolerance for Child Sexual Abuse Material (CSAM) or any content that exploits or endangers minors. HypeReel is a personal content creation tool, and using it — in any form — to produce, process, or distribute material that sexualizes children (whether real, fictional, AI-generated, implied, or inferred) is categorically prohibited.

By accessing the Service, you expressly agree to the following:

• Prohibited Content: You will not use the Service to input, generate, or output any material depicting children in a sexualized context or relating to child exploitation, abuse, or endangerment.
• No Distribution: Even though the Service does not include in-app social sharing, creating CSAM via our tools for storage or distribution elsewhere violates these Terms and applicable law.

Built-In Protections

HypeReel is structured around curated templates and guided creation workflows — it is not an open-ended generative platform. This architecture is intentionally designed to prevent the production of content that places minors in compromised or sexualized contexts.

• AI Partner Compliance: We work with leading AI providers and rely on their safety filters and content moderation APIs to automatically detect, block, and reject violating inputs.
• Monitoring & Reporting: We do not access private content stored locally on your device. However, automated safety systems may apply signals during upload, processing, or generation. Suspected CSAM-related activity may result in enforcement action and reports to NCMEC and/or law enforcement where required by law.
• Permanent Bans: Anyone found attempting to jailbreak, reverse-engineer, or circumvent our safeguards to generate CSAM will be permanently banned without notice.

Report Child Exploitation

HypeReel actively supports global efforts to protect children online. If you come across exploitative material or need to report a concern, the following organizations can help:

Using HypeReel comes with responsibilities. The following are strictly off-limits:

• Breaking any law, regulation, or court order that applies to your use of the Service;
• Submitting, creating, or processing content that is unlawful, deceptive, abusive, obscene, hateful, violent, threatening, defamatory, or otherwise in violation of these Terms;
• Violating the intellectual property, privacy, publicity, or other legal rights belonging to any individual or organization;
• Tampering with, disabling, or working around any security measures, content restrictions, or usage controls built into the Service;
• Attempting to decompile, reverse engineer, or extract source code or model weights from the Service, unless expressly authorized under applicable law;
• Deploying bots, crawlers, scrapers, or other automated tools to interact with or harvest data from the Service without our written consent;
• Introducing malicious software, viruses, or harmful scripts, or leveraging the Service as a channel for sending spam;
• Transferring your login credentials to others or permitting unauthorized access to the Service via your account;
• Engaging in any other behavior that conflicts with applicable laws, App Store guidelines, or recognized regulatory standards.

Any images or videos you upload or submit through the Service ("User-Generated Content" or "UGC") remain yours. Your ownership of that content is not affected by these Terms, except as described in the license below.

HypeReel is a personal creation tool built around curated templates and guided workflows — it is not a social platform, and there is no mechanism for publishing or sharing your content with other users inside the app. Finished outputs can be downloaded for your own personal use.

To operate and maintain the Service, you grant us a limited, non-exclusive license to host, process, transmit, and temporarily store your UGC. This license exists solely for the purpose of delivering the Service to you. We will not use your UGC to train AI or machine learning models without your explicit consent, as set out in our Privacy Policy.

You bear full responsibility for the UGC you submit and warrant that you have secured all rights, permissions, and consents necessary to upload and process that content through the Service.

Some of HypeReel's features are powered by automated, algorithmic, or AI-based processes ("AI Features"). Both the content you provide as input ("Input") and the content the Service produces in return ("Output") are considered User-Generated Content for the purposes of these Terms.

AI Output Disclaimer

Outputs from AI Features are generated automatically and may be imprecise, incomplete, or produce results you did not anticipate. Because multiple users may submit similar requests, Outputs may not be unique. Before acting on any Output, you should independently review and verify it.

Nothing produced by the Service constitutes professional, legal, medical, or other regulated advice. You agree not to substitute AI-generated Outputs for qualified professional judgment, and you assume full responsibility for how you use them.

Safety Enforcement & Credit Policy

Automated systems run continuously to identify and block content that violates these Terms or is otherwise objectionable. When a request or generated result is flagged, we may suppress the Output and display a notice within the app.

In certain circumstances — such as when content is withheld due to our safety systems or a confirmed technical error — we may return the credits consumed for that generation to your in-app balance. This credit restoration carries no monetary value and does not constitute or entitle you to a cash refund of any kind.

A "Report" button is available on both template pages and generated-result pages, giving you a direct way to flag content you find objectionable.

How You Can Pay

HypeReel offers two types of paid access:

• Recurring subscriptions that automatically renew and give you continued access to certain features or usage allowances; and
• One-time consumable purchases, such as in-app credits or usage tokens.

Payments are handled exclusively by the platform through which you downloaded the App — the Apple App Store or Google Play. All transactions are governed by that platform's own terms and policies. Prices, billing cycles, and available options may differ by region and will be shown to you before purchase.

Subscription Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel it beforehand. Apple App Store subscribers must cancel at least 24 hours before the current period ends. Google Play subscribers can cancel at any point, with access continuing through the end of the paid period already charged. Please note: removing the App from your device does not cancel your subscription on either platform.

Cancelling or Modifying

To make changes to or cancel your subscription, visit the account settings on the platform where you purchased it:

• Apple App Store: Manage subscriptions via your Apple ID account settings.
• Google Play: Manage subscriptions via the Google Play app or your Google account.

Getting a Refund

Refund requests for cash payments must go directly to the platform that processed your transaction — we do not have the ability to issue cash refunds for App Store or Google Play purchases ourselves.

• Apple App Store: Refunds are handled by Apple under their applicable policies.
• Google Play: Refunds are handled by Google under their applicable policies. Past subscription periods are generally non-refundable. Unauthorized charges may be eligible for a refund if reported within 120 days of the transaction date.

At our discretion, we may credit your in-app balance with restored credits in specific situations — for instance, when a generation is blocked by safety enforcement, flagged for a suspected policy violation, or lost due to a technical error. Credits restored this way hold no cash value, cannot be transferred, and may come with additional conditions.

Non-Refundable Purchases

Except where required by law, all consumable in-app purchases — including credits and usage tokens — are final once completed, regardless of whether they have been used. Amounts paid for any active subscription period are not refundable, and we do not provide pro-rated credits for any remaining unused time within a billing cycle.

What Happens When You Delete Your Account

You are free to delete your account at any time through the Account settings page. Once your account is deleted, all remaining assets — including any active subscription entitlements and unused credits — are forfeited immediately and cannot be restored. This action is permanent. No refunds will be issued for forfeited assets upon account deletion, except where applicable law requires otherwise.

How we handle your personal information is fully described in our Privacy Policy. That document covers what data we collect, how it is used, how long it is retained, and the measures we take to keep it secure. These Terms incorporate the Privacy Policy by reference.

Depending on where you live, specific privacy regulations may apply to you. If you are in the European Economic Area, the United Kingdom, or Switzerland, the GDPR governs our handling of your data, and you hold rights that include access to your data, correction of inaccuracies, erasure, processing restrictions, the right to object, and data portability. If you are a California resident, the CCPA gives you the right to know what personal information we have collected about you, to request its deletion, and to opt out of certain data-sharing practices where applicable.

To act on any of these rights, please follow the steps outlined in our Privacy Policy. We are committed to responding within the timeframes required by applicable law.

In plain terms: HypeReel is provided as-is and as-available. We make no warranties of any kind — express, implied, or statutory — to the fullest extent the law allows. This means you are using the Service without any guarantee of quality, reliability, or fitness for your intended purpose.

We make no guarantees that the Service will run without interruption, remain free of errors, be secure at all times, or be clear of harmful components. Equally, we make no promise that any AI-generated Output will match your expectations, suit your specific needs, or be free from inaccuracies. All implied warranties — including those of merchantability, fitness for a particular purpose, title, and non-infringement — are expressly disclaimed.

To the maximum extent permitted by law, HypeReel will not be responsible for damages that fall into any of the following categories: indirect, incidental, consequential, special, exemplary, or punitive — regardless of how they arise. This exclusion covers losses such as lost profits, lost data, loss of goodwill, or harm resulting from your use of or inability to access the Service.

Should any claim against us succeed despite the above, our total aggregate liability under these Terms is capped at whichever is greater: (a) the total amount you paid for the Service during the 12-month period leading up to the event that gave rise to the claim, or (b) USD $100 — unless a different minimum is mandated by applicable law.

You are free to stop using the Service whenever you choose. On our end, we may suspend or permanently terminate your access at any time — with or without advance notice — if you violate these Terms or if allowing your continued access would create legal or regulatory exposure for us. When your access ends for any reason, all licenses we granted you under these Terms are immediately revoked and you must cease all use of the Service.
